NC House Introduces HB381 to Streamline On-Site Wastewater System Approvals

The North Carolina General Assembly introduced House Bill 381, titled On-Site Wastewater System Amendments, which aims to modernize the approval process for innovative on-site wastewater systems. Sponsored by Representative Warren, the bill simplifies regulatory pathways for advanced wastewater treatment technologies, ensuring North Carolina remains at the forefront of sustainable and effective wastewater management.

The proposed legislation revises G.S. 130A-343(g)(3) by allowing wastewater treatment systems that have been evaluated and approved by a nationally recognized certification body for at least two consecutive years to be automatically eligible for innovative wastewater system approval. This change reduces bureaucratic delays and provides clarity for manufacturers, engineers, and installers.

This bill is a significant step forward for North Carolina’s wastewater industry. By aligning our approval process with national standards, we are encouraging the adoption of cutting-edge technologies that improve water quality, protect public health, and provide more options for property owners.

Under the amended statute, the North Carolina Department of Health and Human Services (DHHS) will approve an innovative wastewater system if it meets two key conditions:

  1. The system has already been approved by a nationally recognized certification body and has demonstrated performance for at least two years.

  2. The design and installation are consistent with the system evaluated and approved by the certification body.

These updates are expected to benefit property developers, engineers, and wastewater professionals by accelerating market access for proven wastewater treatment solutions. It will also provide homeowners and businesses with more efficient, environmentally friendly wastewater treatment options.

The bill takes effect immediately upon becoming law and will apply to all applications for innovative wastewater system approval filed thereafter.
